Terms of service

These Terms of Use (hereinafter referred to as ""these Terms"") define the terms and conditions for using the online shop (hereinafter referred to as ""the Service"") provided by Arco Co., Ltd. (hereinafter referred to as ""the Company"") on this website. Registered users (hereinafter referred to as ""Users"") shall use the Service in accordance with these Terms.

Article 1 (Applicability)

  1. These Terms shall apply to all relationships between Users and the Company regarding the use of the Service.
  2. In addition to these Terms, the Company may establish various rules and regulations (hereinafter referred to as ""Individual Provisions"") regarding the use of the Service. These Individual Provisions, regardless of their name, shall constitute a part of these Terms.
  3. In the event of any conflict between the provisions of these Terms and Conditions and the provisions of the individual provisions in the preceding paragraph, the provisions of the individual provisions shall prevail unless otherwise specifically stipulated in the individual provisions.

Article 2 (User Registration)

  1. In this service, user registration is completed when the applicant agrees to these Terms and Conditions, applies for user registration in the manner prescribed by the Company, and the Company notifies the applicant of its approval.
  2. The Company may not approve an application for user registration if it determines that the applicant falls under any of the following circumstances, and shall have no obligation to disclose the reasons for such refusal.
    1. If false information is provided when applying for user registration
    2. If the application is from a person who has previously violated these Terms of Service
    3. In other cases where the Company deems user registration inappropriate

Article 3 (Management of User ID and Password)

  1. Users shall manage their user ID and password for this service at their own responsibility.
  2. Under no circumstances may a user transfer, lend, or share their user ID and password with a third party. Our company considers that if a user logs in using a combination of user ID and password that matches the registered information, it is being used by the user who registered that user ID.
  3. Our company shall not be liable for any damages caused by the use of a user ID and password by a third party, except in cases of intentional misconduct or gross negligence on our part.

Article 4 (Sales Contract)

  1. In this service, a sales contract is concluded when a user applies to our company for purchase and our company notifies the user that it has accepted the application. Ownership of the product shall transfer to the user when our company hands over the product to the delivery company.
  2. Our company may terminate the sales contract in the preceding paragraph without prior notice to the user if the user falls under any of the following circumstances.
    1. If the user violates these terms and conditions
    2. If delivery of the product cannot be completed due to an unknown delivery address or prolonged absence
    3. In other cases where we deem that the relationship of trust between us and the user has been damaged
  3. Regarding payment methods, delivery methods, cancellation methods for purchase applications, and return methods related to this service, etc., these will be determined separately by us.

Article 5 (Intellectual Property Rights)

The copyrights and other intellectual property rights of product photographs and other content (hereinafter referred to as ""Content"") provided through this service belong to our company and other legitimate rights holders such as content providers, and users may not reproduce, reprint, modify, or otherwise make secondary use of them without permission.

Article 6 (Prohibited Actions)

When using this service, users shall not engage in the following actions:

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activity
  3. Acts that infringe copyrights, trademarks, or other intellectual property rights included in this service
  4. Acts that destroy or interfere with the functionality of our servers or network
  5. Acts that commercially utilize information obtained through this service
  6. Acts that may interfere with the operation of our services
  7. Acts of unauthorized access or attempts to do so
  8. Acts of collecting or accumulating personal information of other users
  9. Impersonating another user
  10. Providing direct or indirect benefits to anti-social forces in connection with our services
  11. Other acts that we deem inappropriate

Article 7 (Suspension of Service Provision, etc.)

  1. We may suspend or interrupt the provision of all or part of this service without prior notice to the user if we determine that any of the following circumstances exist.
    1. When performing maintenance, inspection, or updates to the computer system related to this service
    2. When it becomes difficult to provide this service due to force majeure such as earthquakes, lightning strikes, fires, power outages, or other natural disasters
    3. When the computer or communication lines stop due to an accident
    4. In other cases where we determine that it is difficult to provide this service
  2. We shall not be liable for any disadvantages or damages suffered by users or third parties due to the suspension or interruption of the provision of this service, regardless of the reason.

Article 8 (Restrictions on Use and Deregistration)

  1. We may, without prior notice, restrict a user's use of all or part of this service, or deregister the user, if any of the following conditions apply.
    1. If you violate any provision of these Terms and Conditions
    2. If it is discovered that there are false facts in the registration information
    3. If the credit card registered by the user as a payment method is suspended
    4. If there is a default in payment obligations such as fees
    5. If you do not respond to our contact for a certain period of time
    6. If you do not use this service for a certain period of time since your last use
    7. In other cases where we deem your use of this service inappropriate
  2. We shall not be liable for any damages incurred by the user as a result of actions taken by us pursuant to this article.

Article 9 (Withdrawal)

Users may withdraw from this service by following the prescribed withdrawal procedure.

Article 10 (Disclaimer of Warranties and Limitation of Liability)

  1. We do not guarantee that this service is free from factual or legal defects (including defects, errors, bugs, and infringements of rights related to safety, reliability, accuracy, completeness, effectiveness, and suitability for a particular purpose).
  2. We shall not be liable for any damages incurred by users as a result of this service.
  3. However, if the contract between us and the user regarding this service (including these Terms and Conditions) constitutes a consumer contract as defined in the Consumer Contract Act, this disclaimer provision will not apply. Even in this case, however, we shall not be liable for any damages incurred by the user due to our breach of contract or tort (excluding gross negligence) arising from special circumstances (including cases where we or the user foresaw or could have foreseen the occurrence of such damages).
  4. We shall not be liable for any transactions, communications, or disputes that occur between the user and other users or third parties regarding this service.

Article 11 (Changes to Service Content, etc.)

We may change the content of this service or discontinue providing this service without notifying the user, and shall not be liable for any damages incurred by the user as a result.

Article 12 (Changes to Terms of Use)

We may change these Terms of Use at any time without notifying users if we deem it necessary. If a user starts using the Service after the Terms of Use have been changed, that user will be deemed to have agreed to the changed Terms of Use.

Article 13 (Handling of Personal Information)

We will handle personal information obtained through the use of the Service appropriately in accordance with our ""Privacy Policy"".

Article 14 (Notices or Communications)

Notices or communications between the user and us shall be made by the method specified by us.

Unless the user submits a change notification in accordance with the method separately specified by the Company, we will consider the currently registered contact information to be valid and will send notifications or communications to that contact information, and these will be deemed to have reached the user at the time of transmission.

 

Article 15 (Prohibition of Assignment of Rights and Obligations)

The user may not assign their status under the service agreement or any rights or obligations under these Terms to a third party, or provide them as security, without the prior written consent of the Company.

Article 16 (Governing Law and Jurisdiction)

  1. The interpretation of these Terms shall be governed by Japanese law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this service.
  2. In the event of any dispute arising in connection with this service, the court having jurisdiction over the location of our head office shall be the exclusive agreed court of jurisdiction.
